- NOTICE OF INTENT TO SOLE SOURCE The Department of Veterans Affairs, VISN 4, Louis A Johnson, VAMC, intends to award a sole-source delivery order to Angiodynamics Incorporated, 603 Queensbury Ave., Queensbury, NY 12804, for the following medical equipment and supplies: 1)Mfr: ANGIODYNAMICS INCORPORATED, Item: VENACURE 1470 LASER; Part# VCURE1470/US 2)Mfr: ANGIODYNAMICS INCORPORATED; Item: 45cm NEVERTOUCH VENUCARE EVT PROCEDURE KITS; Part# 11403001-FRS 3)Mfr: ANGIODYNAMICS INCORPORATED; Item: 65cm NEVERTOUCH VENACURE EVTL PROCEDURE KIT; Part# 11403002-FRS 4)Mfr: ANGIODYNAMICS INCORPORATED; Item: 90cm NEVERTOUCH VENACURE EVTL PROCEDURE KIT; Part# 11403004-FRS 5)Mfr: ANGIODYNAMICS INCORPORATED; Item: KIT WITH 400um FIBER PROCURED KIT; Part# ELVT/PVAK Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals or a solicitation. However, parties interested in responding to this notice shall submit technical data, including cost, sufficient to determine capability in providing the same product to Mario Bombardiere, Contract Specialist, at mario.bombardiere@va.gov by January 3, 2014, no later than 11:00 AM EST. All capability statements received by closing of this notification will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive procurement. This acquisition is being conducted under FAR Part 13 procedures. The proposed procurement will be classified under North American Industry Classification System (NAICS) 339122 with a Small Business Size Standard of 500 employees. This is for informational purposes only and not to be construed as a commitment by the Government. Any information submitted to this notice of intent is voluntary. DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 04, Louis A. Johnson VA Medical Center 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for an Endovascular Laser Treatment System and disposable procedure kits. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The system will be used to perform minimally invasive laser therapy of venous insufficiency on patients in an outpatient setting as determined by medical staff. The VenaCure 1470 Laser is the only product on the market with a wavelength of 1470 which allows us to close the veins with less energy. This means less post-operative pain to the patient. This is the only product to provide the NeverTouch Fiber, which is distinctly different from the bare fiber tips provided by other companies. The NeverTouch Fiber design focuses on further reducing post-operative pain to the patients undergoing venous ablation. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a.Only One Responsible Source (FAR 6.302-1): Market research was not successful at finding other possible sources. A FSS waiver was submitted and approval concurred to proceed with procurement of the system. b.Unusual and Compelling Urgency (FAR 6.302-2, 6.303-2(a)(9)(ii)): c.Industrial Mobilization; or Engineering, Developmental, or Research Capability (FAR 6.302-3): d.Authorized or Required by Statute (FAR 6.302-5): e.National Security (FAR 6.302-6): f.Public Interest (FAR 6.302-7): 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Government is receiving a discount of $33,275.00 off the list price of the Venucare 1470 Laser. Our quoted price of $25,000.00 for the Venucare 1470 Laser is reasonable based on pricing found in the market research. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted on GSA and FSS that resulted in no potential sources. A search of VetBiz did not result in any SDVOSB or VOSB contractors capable of providing the supply requested by the service. AngioDynamics Incorporated is an open market small business vendor. This meets the Small Business socioeconomic requirement of the VA. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: The Venucare 1470 Laser is used in these ablation procedures and is considered the standard of care in comparison to vein stripping. In addition, cost research was conducted to determine potential savings to the Government performing the procedures versus sending patients to fee basis providers. A savings of approximately $99,000.00 for a year was calculated by utilizing an average cost of $4,144.50 per procedure and 24 patients per year. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: NA 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: NA
