- This is a NOTICE OF INTENT for sole source procurement of commercial supplies prepared in accordance with the format in Subpart 12.6 and Part 13, as supplemented with additional information included in this notice. The Government intends to solicit and negotiate with only one source under the authority of Section 4202 Clinger Cohen Act of 1996, as set forth in FAR Part 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. INO Therapeutics LLC is currently the only known source approved by the FDA for providing inhaled nitric oxide approved for human use. This announcement constitutes the only notice of intent. The Department of Navy (DoN), The National Naval Medical Center, Bethesda, MD, intends to negotiate on a sole source basis with INO Therapeutics LLC to provide INOmax [Nitirc Oxide] for inhalation to patients at National Naval Medical Center Bethesda, MD. Both the machine and the nitric gases needed to perform pulmonary functions to the patients are included in the requirement, as well as machine maintenance. The anticipated performance period for this procurement will be 01 October 2009 [with a base period of one year] through 30 Sept 2014 [if all four one year options are exercised]. Interested persons may identify their interest and capability to respond to the requirement by sending challenges to Cathy Kelly at cathy.kelly@navy.mil. This notice of intent is NOT a request for competitive proposals; however, all challenges to this sole source determination received within 3 days after date of publication of this synopsis will be considered by the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this proposed contract (or purchase order) based upon responses to this notice is solely within the discretion of the Government.
