Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6. The PTO plans to award a commercial item contract utilizing simplified acquisition procedures to the offeror that provides the best value to the government considering price, quality, warranty and past performance factors. Due to the proprietary nature of the manufacturer?s software, only the software manufacturer, Opsware, Inc., or one of the manufacturer?s officially authorized software resellers to the government is qualified to receive award of the commercial item contract under this requirement. Any questions pertaining to manufacturer part numbers or authorized reseller status should be directed to Opsware?s point of contact, Chris Stewart, at (919) 6191990. All qualified vendors should submit a price proposal for the following items under the following terms and conditions: Item 1 ? AMS 2501-5000 Agents Quantity 4000 Manufacturer Part Number - AMSAGT-5000 Item 2 ? AMS Gold: 5x12 Support Quantity 4000 Manufacturer Part Number - AMS GOLD The above specified brand name software is required in that it has been integrated into the USPTO?s affected systems. The cost and effort to integrate another software would be significant. This announcement constitutes the RFP and is the only solicitation that will be issued. This solicitation incorporates all of the applicable provisions of FAR clause 52.212-1. Offerors must include a completed copy of the provision at 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS ? COMMERCIAL ITEMS, with its offer. The successful offeror will be awarded a firm fixed price commercial item contract for the above requirement using simplified procedures. The commercial item contract will contain the terms and conditions of FAR clause 52.212-4 CONTRACT TERMS AND CONDITIONS ? COMERCIAL ITEMS and the applicable terms and conditions of FAR clause 52.212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS ? COMMERCIAL ITEMS. Any qualified vendor wishing to propose on the above requirement should submit a firm fixed price proposal, responsive to the requirements of this combined synopsis/solicitation, to the Patent and Trademark Office, Office of Procurement, via E-Mail to Chris.Hannah@USPTO.GOV no later than 4:00 P.M.
